  4.             SUMMARY OF STATE LIVING WILL LEGISLATION

  8. Synopsis: Mississippi has a strong living will statute. The
  9. statute involves the State Bureau of Vital Statistics. Before
  10. implementing a living will the physician must contact the
  11. Mississippi Bureau of Vital Statistics and verify that the living
  12. will is on record and has not been revoked. The statute requires
  13. that living wills be recorded, as well as revocations of the
  14. same. The statute does not require that a physician or hospital
  15. to follow a living will, but does require that the doctor or
  16. hospital cooperate in transferring the patient to a doctor or
  17. hospital which will honor the living will. To prepare a
  18. Mississippi living will using the state mandated form, please
  19. select this option from the opening menu. Remember that the
  20. publisher recommends preparing a "uniform" living will in
  21. addition to the form required by the State of Mississippi. Please
  22. also consider executing a living will for any State that you
  23. spend more than a few weeks per year, or where you are a
  24. temporary resident.

  36. be related by blood or marriage, may not have a claim against the

  39. the declarant is a patient; or entitled to any part of the estate
  40. of the declarant under any will, or by intestacy

  43. Statistics, State Board of Health

  45. Revocation of the living will may be made by written instrument,
  46. which must be recorded at the State Board of Health, a verbal
  47. revocation to the attending physician is also valid.
